Walmart Settles Grocery Overcharge Lawsuit
February 28, 2024
Walmart, the retail chain boasting over 4,600 locations across the United States, faced legal scrutiny in October 2022. Allegations arose that the company had been overcharging customers for groceries sold by weight. The official legal document used in the proceedings alleges that “Walmart falsely inflated product weight, mislabeled the weight of bagged produce and overcharged for clearance items.”
Walmart initially refuted any type of wrongdoing in this matter, flat-out denying the claims made against them. However, following the filing of this class action lawsuit, Walmart has changed its tune and has now agreed to a substantial $45 million settlement.
Despite maintaining its innocence, Walmart chose to pursue this settlement to avoid protracted litigation. The agreement is pending final approval from the United States District Court for the Middle District of Florida, with a hearing slated for June 12, 2024.
Customers who purchased eligible weighted groceries from Walmart between Oct. 19, 2018, and Jan. 19, 2024, may qualify for compensation. Those able to provide proof of purchase could receive up to 2% of the total cost, capped at $500. For those without receipts, claims ranging from $10 to $25 are still possible.
To opt out of the settlement, requests must be submitted to the settlement administrator by May 22, 2024. Claim forms must be filed by June 5, 2024, either through an online portal or by traditional mail.
